Does jewellery count as household goods in an estate?

No - as a rule it does not. § 1932 BGB governs the surviving spouse's so-called Voraus (advance entitlement) to the household goods: the spouse receives the household goods in addition to their share of the estate, to the extent that they need them "for an appropriate standard of living". In legal terms jewellery does not count as household goods, but as personal valuables. One exception: jewellery predominantly used jointly by both spouses (for example a shared set of wedding rings) can, in individual cases, be treated as household goods. In an inheritance dispute, jewellery is therefore usually valued separately and distributed according to the shares of the estate. Anyone who wants a particular person to receive a specific piece should set out a preferential legacy (Vorausvermächtnis) in their will (see the FAQ below).

How is jewellery valued in an estate?

Several valuation methods are common. Market value: the realistic sale price on the day the succession took effect - the figure that matters legally under the German Valuation Act (BewG). With an antique mourning ring, the market value can differ considerably from the material value (gold content), depending on collector interest, provenance and condition. Goldsmith's purchase price: the value a goldsmith offers for melting the piece down - usually 50–70 % of the market value. Insurance replacement value: what it would cost to have an equivalent replica made - usually 130–180 % of the market value. Sentimental value: the individual emotional value for a family member - legally irrelevant, but often more decisive than the material value when it comes to distribution within the family. Recommendation for more valuable pieces (over 5,000 EUR): a written expert appraisal (typically 200–600 EUR per piece) creates clarity and avoids later disputes.

How can I prevent my memorial jewellery from being sold after my death?

Several options. A legacy in your will: you specify expressly who is to receive a particular piece of jewellery. The legacy is legally binding and cannot be contested by other heirs, as long as it does not infringe the compulsory-share entitlement. A gift during your lifetime: you transfer the piece to the person you have in mind while you are still alive - as a formal gift with a written transfer of ownership. Advantage: you get to see the recipient's joy. Disadvantage: the claim to supplement the compulsory share applies to gifts made up to 10 years before death. A preferential legacy with a condition: the piece goes to a particular person on condition that they pass it on in turn (for example to the next generation). For pieces with a particularly personal charge - such as a memorial pendant containing the ashes or the fingerprint of a deceased person - this is a sensible option. A foundation: for very valuable family pieces, a family foundation can be established to administer the jewellery holdings in the long term. The effort and cost make this worthwhile only for larger collections.

What happens to memorial jewellery (an ash or fingerprint pendant) when the wearer dies?

An emotionally and legally delicate question. The memorial piece contains substances - ash, a fingerprint, hair - belonging to someone who has already died. Several practical routes are discussed. Passing it to the next generation: the piece is inherited, and the substances it contains pass on as part of the estate. In practice the most common solution. Burial with the wearer: the piece is buried together with the wearer - a particularly intimate variant that symbolises the personal bond beyond death. In a cremation the piece is typically removed beforehand (cremation with precious metal is technically problematic), but it can be interred with the urn. Return to the family of the person who died first: where the piece is returned to that person's family (often through a legacy), the memorial substance is in a sense "brought home". Recommendation: set out the preferred solution expressly in your will, and communicate it within the family in advance.
