How does an NFC chip in a piece of jewellery work?

With typical contract terms of 5–25 years, there is no guarantee the page will remain reachable across generations. URL stability: web addresses can change (on switching provider, for example). An NFC chip with a hard-coded URL then goes "blank". File formats: today's usual photograph and video formats (JPG, MP4) may no longer be readable without difficulty in 50 years. Internet availability: the whole solution presupposes a functioning internet infrastructure. Recommendation: treat digital remembrance as a supplement to classical forms (jewellery, photographs, a written collection of memories), not as a replacement. Some providers additionally offer a "data trust" for 50–100 years, with regular migration of the data into current formats.

Which data-protection questions arise with digital remembrance?

Several. Post-mortem personality rights: in Germany and Austria the dead enjoy a limited personality right; photographs, videos and texts may not simply be made publicly accessible. A memorial page that can also be opened by third parties (a smartphone scanning the NFC chip on a headstone) is delicate in data-protection terms. Recommendation: protect access with a password or access code. Relevance under the GDPR: as soon as personal data of family members still living appears on the memorial page (family photographs including the widow or the children, say), GDPR rules apply. Obtain the consent of everyone depicted. Questions of inheritance: who has the right to administer, alter or delete the memorial page? Recommendation: set out a clear chain of authorisation in the contract (typically: one bereaved person with principal responsibility, thereafter the line of succession). Provider insolvency: what happens to the data if the provider goes under? Before signing, clarify whether a data trust or insolvency-protection mechanism exists.
